Information on the data transfer to third-party countries that are not secure under data protection law and the transfer to US companies that are not DPF-certified

We use, among other technologies, tools from companies located in third-party countries that are not safe under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). We use online conference tools, among other things, for communication with our customers. The tools we use are listed in detail below. If you communicate with us by video or audio conference using the Internet, your personal data will be collected and processed by the provider of the respective conference tool and by us. The conferencing tools collect all information that you provide/access to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).

Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Handling applicant data

13. SimPlan offers in app stores of Google, Microsoft and Apple (SimPlan Apps)

Range of functions

We offer several apps that can be used on mobile devices (smartphones, tablets). Currently these are SimVSM for value stream mapping & simulation and SimQueue for the evaluation of queueing networks.

We offer free standalone versions via the app stores as well as the possibility to purchase additional functionalities via in-app purchases.

Data collection when using the apps

Your personal data is collected on the one hand by automatically transmitting it to us on the basis of your voluntary consent pursuant to Art. 6 para. 1 p. 1 lit. a), 7 para. 1 EU-GDPR (per consent) by downloading our mobile app from one of the app stores of the providers Google, Microsoft or Apple.

During data collection, as soon as you download the mobile app, register and log in, the following data is generally collected, i.e. our mobile app collects – basically on an optional basis – so-called absolutely necessary data pursuant to Art. 6 para. 1 sentence 1 lit. f) EU-GDPR (legitimate interests) in conjunction with Art. 25 TTDSG (protection of personal data). § 25 TTDSG (protection of privacy for terminal equipment), e.g.:

(1) Personal data, such as first name/last name, company, user IDs, and contact data such as email address for the purpose of app account management.

(2) App information and performance from a technical perspective, such as crash logs and diagnostic data for the purpose of app analysis and optimisation.

(3) Device or other ID’s, such as characteristics of the end device (software and hardware) to improve the functionality of the apps in connection with (2).

(4) Files and documents as well as photos and videos within the scope of using the app for the purpose of providing the service. Details of stored data and photos are described in detail at www.simvsm.info.

As a matter of principle, we (SimPlan) do not request financial data in connection with the apps, as purchase and billing are carried out via Apple, Google or Microsoft and the terms and conditions of the respective app stores (see below) apply. The apps also do not collect any data to analyse user behaviour.

In addition, the web server automatically processes information in “server log files” in accordance with Art. 6 para. 1 p. 1 lit. b) EU-GDPR (contractual purposes), depending on the scope of functions purchased, as soon as you download the mobile app and are logged into the web server for this purpose and access the functions of the mobile app, such as:

(1) device manufacturer and type

(2) operating system

(3) Host name of the accessing computer

(4) Time of the server request

(5) IP address

“Server log files” are log files that contain the automatically maintained record of all or certain actions of processes on a computer system.

We do not share data with third party companies or organisations as a matter of policy. Unless consent pursuant to Art. 6 para. 1 p. 1 lit. a) EU-GDPR (by consent) is given or the third party is an order processor pursuant to Art. 28 EU-GDRP. Data may also be transferred to third parties if this is necessary for the fulfilment of a contract pursuant to Art. 6 Para. 1 Sentence 1 lit. b) EU-GDPR (contractual purposes), e.g. for the purpose of processing payments with commissioned credit institutions.

Data transmission is always encrypted and we always offer the option of deleting data after application or when the purpose has been achieved or according to the law.

The SimPlan apps do not use cookies.

Access to the SimPlan apps

The SimPlan apps SimVSM and SimQueue can be downloaded free of charge from the Apple, Microsoft and Android stores. Additional functions can be purchased via in-app purchases. The payment and settlement of in-app purchases takes place via the respective app stores. The responsibility for payment terms and payment processing lies exclusively with the app stores.

We are not responsible for the data processing of Apple, Microsoft and Android pursuant to Art. 4 No. 7 EU-GDPR, but the aforementioned companies themselves. You can find out more about data processing by these providers at:
